Agricultural Law

Wills/Administration of Estates

It is vital that everyone makes a Will to ensure their wishes are fulfilled after they pass away. It is particularly important from a tax perspective to make a Will to ensure your Estate is bequeathed to those you wish to benefit in the most tax efficient manner. If you have young children or a family member suffering from a disability, Trustees will have to be appointed in your Will to protect them. The administration of Estates is the distribution of a person’s property after their death, either in accordance with their Will or the rules of intestacy, whichever applies. If you have been appointed the Executor of an Estate or your loved one has passed away without a Will, or you are a beneficiary of Will/Estate and have a concern, you should seek legal advice as soon as possible. With our experience, we can advise you in a clear and practical manner.

We also provide advices on and prepare Enduring Powers of Attorney. This is a document signed by a person (called a donor) appointing certain people to act as their Attorneys and deal with their affairs in the event the donor becomes mentally incapacitated. Failure to execute an Enduring Power of Attorney and then becoming mentally incapacitated, can result in an application being brought to have the mentally incapacitated person made a Ward of Court. If this happens, we have also provided advices and expertise in this regard. Finally, we have also advised clients in relation to Nursing Home Support Scheme Applications (otherwise known as the Fair Deal Scheme).
